  1. About These Terms

Balance Through Menopause™ is operated by PeriBalance, LLC, d/b/a Balance Through Menopause, (“Balance Through Menopause,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of balancethroughmenopause.com, related Kajabi pages, emails, communities, digital materials, assessments, workshops, courses, programs, memberships, live calls, recordings, and other services we provide (collectively, the “Services”).

These Services include AmiBalance™, Balance Beyond Menopause™, their corresponding continuation memberships, The Regulation Gap in Menopause, and other offerings identified at purchase.

By accessing the Services, creating an account, or making a purchase, you agree to these Terms and acknowledge our Privacy Policy and Refund & Cancellation Policy. If you do not agree, please do not use the Services.

  1. Eligibility

The Services are intended for adults age 18 and older. By using the Services, you represent that you are at least 18 years old and legally able to enter into this agreement. The Services are intended for individual, personal use unless we agree otherwise in writing.

  1. Educational Services—Not Psychotherapy or Medical Care

Balance Through Menopause provides education, guided practices, self-reflection resources, community support, and general information related to perimenopause, menopause, postmenopause, wellbeing, and nervous-system support.

Although Iwona Gerner is a licensed psychotherapist, your purchase or participation does not establish a therapist-client relationship. The Services are not psychotherapy, counseling, medical care, diagnosis, treatment, crisis care, or a substitute for individualized care from a licensed healthcare professional who knows your history.

Information provided through the Services is general and may not be appropriate for every person. Do not disregard or delay professional medical or mental-health advice because of something presented through the Services. Speak with an appropriate healthcare professional before making decisions about symptoms, medication, treatment, exercise, or other health matters.

If you believe you may be experiencing a medical or mental-health emergency, call 911 or your local emergency service. In the United States, you may call or text 988 for the Suicide & Crisis Lifeline. Do not use program messages, community posts, or email to seek emergency assistance.

  1. Your Participation and Responsibility

You remain responsible for your choices, actions, health, and wellbeing. You may pause, modify, or decline any exercise or practice. Participation may bring up physical sensations, emotions, memories, or discomfort. Use your judgment, work within your capacity, and seek individualized professional support when needed.

We do not promise that the Services will prevent, cure, or improve any particular symptom or condition. Experiences and results vary based on many factors outside our control.

  1. Accounts and Security

You agree to provide accurate and current information when creating an account or making a purchase. You are responsible for protecting your username and password and for activity under your account. Accounts and access credentials may not be shared, sold, transferred, or used by more than one person.

Please notify us promptly at [email protected] if you believe your account or payment information has been used without authorization.

  1. Purchases and Payment

Prices, included features, payment schedules, and access periods are disclosed on the applicable sales or checkout page. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment processors to charge the amounts disclosed at checkout, including recurring charges when you select a subscription or membership.

You are responsible for applicable taxes and for keeping your billing information current. If a payment fails, we may retry the charge, pause access, or terminate access until the balance is paid.

Payment Plans

A payment plan divides the total purchase price into installments. It is not a month-to-month membership and does not permit cancellation of the remaining installments merely because you stop participating. Unless the offer states otherwise or applicable law requires otherwise, you remain responsible for the full purchase price.

  1. Recurring Memberships and Automatic Renewal

If you purchase an AmiBalance™ continuation membership, a Balance Beyond Menopause™ continuation membership, or another subscription, it will renew automatically at the billing interval and price shown at checkout until you cancel.

Before you purchase, the checkout page will disclose the recurring price, billing frequency, what is included, and how to cancel. By completing the purchase and affirmatively accepting the recurring-payment disclosure, you authorize us to charge your selected payment method automatically at each renewal.

You may cancel before your next renewal date by using this direct email link: Cancel My Membership.

You may also email [email protected] with the subject line “Cancel My Membership.” Your cancellation stops future renewal charges. Unless the checkout page states otherwise, access continues through the end of the billing period already paid and then ends. Amounts already paid are not refunded except when required by law.

When required by Maryland or other applicable law, we will send an advance renewal or trial-ending notice that identifies the upcoming charge and provides a direct or readily accessible way to cancel.

We may change a membership price or make material changes to membership benefits by giving advance notice as required by law. A price change will apply no earlier than your next renewal following the notice. If you do not agree to the change, you may cancel before it takes effect.

  1. Refunds

Purchases are governed by our Refund & Cancellation Policy, which is incorporated into these Terms. Unless a specific offer expressly provides a different written guarantee, purchases of digital programs, workshops, memberships, and related Services are non-refundable once access is provided, except where applicable law requires otherwise.

Canceling a recurring membership prevents future charges; it does not reverse a payment already processed. Missing a live call, not using the materials, or deciding not to continue does not create a right to a refund.

  1. Program Access and Changes

The duration of access is stated in the applicable offer. When an offer expressly includes “lifetime access,” that means access for as long as we continue to offer and support that digital product in substantially its current form. It does not guarantee that a particular platform, feature, or product will operate indefinitely. When reasonably possible, we will provide notice before permanently retiring a product sold with lifetime access.

We may make reasonable changes to lesson order, facilitators, call dates, platforms, community spaces, practices, or supporting materials to maintain or improve the Services. We may reschedule a live session when necessary and will provide notice when reasonably possible.

If we cancel a paid program in its entirety before providing access, we will provide an appropriate replacement, credit, or refund. This does not apply to individual scheduling changes, participant absences, or interruptions beyond our reasonable control.

  1. Live Calls, Be With™ Sessions, and Community Spaces

Group calls and community spaces are educational and supportive environments, not group psychotherapy. You agree to communicate respectfully and not harass, threaten, discriminate against, exploit, or intentionally harm another participant.

Please protect your own privacy and share only what you are comfortable making known to a group. We ask participants to respect one another’s privacy, but we cannot guarantee that another participant will keep information confidential. Do not post another person’s identifying information, screenshots, recordings, or content without permission.

We may remove content or restrict or terminate participation when reasonably necessary to protect the community, enforce these Terms, or comply with law. Removal for a serious or repeated violation does not entitle the participant to a refund.

Live sessions may be recorded only when we provide notice. If a session will be recorded, you may choose to participate with your camera and microphone off or not attend live and use the recording when available. We will request any additional consent required by applicable law.

You may not personally record a session without our prior written permission and the permission of everyone legally required to consent.

  1. Intellectual Property

The Services—including videos, audio, written lessons, frameworks, names, graphics, assessments, downloads, guided practices, community prompts, and recordings—are owned by or licensed to PeriBalance, LLC and are protected by intellectual-property laws.

When you purchase or access the Services, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the materials for your own noncommercial purposes. You may download materials only when a download option is provided.

You may not copy, reproduce, modify, republish, upload, distribute, sell, license, teach from, create derivative products from, publicly display, or commercially exploit the Services without our prior written permission. You may not share login credentials, course files, recordings, or substantial portions of our materials with others.

Balance Through Menopause™, AmiBalance™, AmiPause™, Be With™, and other program or product names are trademarks or brand identifiers of their respective owner. No right to use them is granted except as needed to identify a Service you lawfully purchased.

  1. Your Content and Feedback

You retain ownership of original content you submit in a community, form, or live interaction. You grant us a limited license to host, display, transmit, and process that content only as reasonably necessary to provide, moderate, secure, and administer the Services.

Do not submit content you do not have the right to share. We will not use your identifiable story, image, words, or testimonial in marketing without separate permission. If you voluntarily provide general feedback or suggestions, we may use them to improve the Services without identifying you.

  1. Third-Party Platforms and Links

We use third-party providers to host content, process payments, send email, conduct live calls, operate communities, and support the website. Your use of those providers may also be governed by their own terms and privacy policies. We are not responsible for a third party’s independent services, content, availability, or privacy practices.

Links to outside resources are provided for convenience and do not necessarily constitute an endorsement.

  1. Email and Electronic Communications

By creating an account or purchasing a Service, you consent to receive transaction-related communications such as receipts, account notices, scheduling information, program updates, and policy notices. These communications are part of providing the Service.

Marketing emails are governed by your communication preferences and applicable law. You may unsubscribe from marketing email using the link in the message. Unsubscribing from marketing does not prevent us from sending necessary transactional or account communications.

  1. Acceptable Use

You may not use the Services to:

  • Violate any law or another person’s rights.
  • Impersonate another person or misrepresent your affiliation.
  • Distribute malware, interfere with security, or attempt unauthorized access.
  • Scrape, harvest, or collect participant or user information.
  • Solicit participants for unrelated commercial purposes without permission.
  • Post unlawful, abusive, discriminatory, defamatory, or infringing content.
  • Use the Services or materials to create, market, or deliver a competing product or service.
  1. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free operation, compatibility with every device, or any particular personal, professional, financial, relational, emotional, or health outcome.

Testimonials and examples describe individual experiences and do not promise that you will receive the same result.

Nothing in these Terms excludes a warranty, right, or remedy that cannot legally be excluded.

  1. Limitation of Liability

To the fullest extent permitted by law, PeriBalance, LLC, its owner, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Services.

To the fullest extent permitted by law, our total liability for a claim relating to a paid Service will not exceed the amount you paid us for that Service during the six months immediately preceding the event giving rise to the claim. For a claim relating only to free Services, our total liability will not exceed $100.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

  1. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless PeriBalance, LLC, its owner, employees, and contractors from third-party claims, losses, or reasonable expenses arising from your unlawful misuse of the Services, your infringement of another person’s rights, or content you submit in violation of these Terms.

This section does not require you to indemnify anyone for conduct for which indemnification cannot legally be required.

  1. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access if you materially or repeatedly violate these Terms, fail to pay amounts due, misuse the Services, or create a credible risk of harm to another person, the community, or our systems.

Sections that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, limitations of liability, dispute provisions, and privacy-related obligations—will survive.

  1. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules, except to the extent the law of your residence must apply.

Before filing a legal claim, you and we agree to make a good-faith effort to resolve the concern informally. Please send a written description of the issue and requested resolution to [email protected].

If the matter is not resolved, any claim may be brought in the state or federal courts serving Frederick County, Maryland, unless applicable consumer law permits or requires another forum.

Nothing in this section prevents either party from seeking urgent injunctive relief or using an available small-claims process.

  1. Changes to These Terms

We may update these Terms as our Services or legal obligations change. We will post the revised Terms with a new effective date. When required, we will provide additional notice or request renewed consent.

Your continued use after an update takes effect means you accept the revised Terms, except where law requires another form of consent.

  1. General Provisions

These Terms, the Privacy Policy, the Refund & Cancellation Policy, and any offer-specific terms presented at checkout form the entire agreement between you and us regarding the Services. If offer-specific written terms conflict with these general Terms, the offer-specific terms control for that purchase.

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent.

We may assign these Terms as part of a reorganization, merger, sale, or transfer of the business, subject to applicable law.
